Terms of Service

These Terms of Service (“Terms”) constitute a binding agreement between you (“you,” “your,” or “User”) and Ryan Searl LLC, a Wyoming limited liability company doing business as Preferred Recruit (“we,” “us,” or “our”), regarding your access to and use of our websites, mobile apps, digital platforms, coaching programs, courses, and related services (collectively, the “Services”).

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, discontinue use immediately.

1. Use of Services

Our Services are intended for individuals of any age and capable of entering into binding contracts. By using our Services, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

2. Accounts and Access

You agree to maintain the confidentiality of your login credentials and accept responsibility for all activities that occur under your account. Ryan Searl LLC reserves the right to suspend or terminate any account at its sole discretion if fraudulent, abusive, or otherwise unauthorized activity is detected.

3. Payments, Subscriptions, and Refunds

Purchases and subscriptions made through our Services are subject to the pricing and payment terms presented at the time of purchase. All payments are final and non-refundable except where otherwise stated in the applicable program policy. You agree to fulfill all financial commitments under your selected plan, regardless of your level of participation.

Payment Authorization and Chargebacks: By purchasing or subscribing, you authorize Ryan Searl LLC to charge your payment method for all agreed amounts. You agree not to initiate chargebacks or disputes without first attempting to resolve the issue directly with our support team.

4. Testimonials and Results

Testimonials, case studies, or success stories shown on our platforms reflect individual experiences and are not typical. Your results may vary depending on numerous factors, including consistency and personal effort.

5. Limitation of Liability

You acknowledge that Ryan Searl LLC does not guarantee results and shall not be liable for anything provided through our Services. To the maximum extent permitted by Texas law, you waive any right to seek damages exceeding the total amount paid to Ryan Searl LLC for the Services that gave rise to the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless Ryan Searl LLC, its affiliates, and their respective employees, contractors, and agents from any claims, damages, losses, or expenses arising out of your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

7. Governing Law, Jurisdiction, and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any arbitration or permitted court proceeding shall take place exclusively in Texas, and you consent to personal jurisdiction in those courts.

8. Force Majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, power outages, labor disputes, or governmental restrictions.

9. Modification of Terms

We may update or modify these Terms at any time by posting revised Terms on our website. Continued use after such updates constitutes your acceptance of the new Terms.

10. SMS Text Messaging

The Preferred Recruit is a recruitment service that provides a recruitment service for high school athletes and transfer athletes. After providing your phone number you will receive phone calls and text messages to book a scholarship strategy call.

You can cancel the SMS service at any time. Just text “STOP” to the short code. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive up to nine messages. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
